Plaintiffs named above have moved the Court for an Order of Partial Default Judgment against Defendant Lionel F. Branscomb, et ux., fdba Pinnacle Concrete Floors, Inc., aka Pinnacle Floors, Inc., as follows:

SUMMARY OF JUDGMENT

2. Judgment Debtor: Lionel F. Branscomb, et ux., fdba Pinnacle Concrete Floors, Inc.

3. Principal Judgment Amount: $10,313.52

4. Liquidated Damages: $1,128.87

5. Interest to Date of Judgment: $414.67

6. Costs: $240.12

7. Attorney Fees: $2,271.75

8. Post Judgment Interest: 15 percent per annum

9. Attorney for Judgment Creditor: Mary L. Stoll

Pursuant to Plaintiffs' Motion for an Order of Partial Default Judgment against Defendant Lionel F. Branscomb, et ux., fdba Pinnacle Concrete Floors, Inc., aka Pinnacle Floors, Inc., and the Court having considered the pleadings on file, including the Order of Default entered on January 28, 2003, and otherwise being generally advised, it is hereby ORDERED that the Plaintiffs be awarded a Partial Default Judgment against Defendant Lionel F. Branscomb, et ux., fdba Pinnacle Concrete Floors, Inc., aka Pinnacle Floors, Inc., representing delinquent contributions covering the period August through December 2002, in the amount of $10,313.52, liquidated damages in the amount of $1,128.87, interest in the amount of $414.67, costs in the amount of $240.12, and attorney fees in the amount of $2,271.75, for a total amount owing of $14,368.93.

IT IS FURTHER ORDERED that such Partial Default Judgment is deemed a final judgment pursuant to FRCP 55 and there is no just reason for delay in entry of such judgment on Plaintiffs' claims herein.

IT IS FURTHER ORDERED that this action remains pending as to the unliquidated claim of the Plaintiffs.

IT IS FURTHER ORDERED that this Partial Judgment shall accrue interest on the total unpaid balance at the rate of 15 percent per annum.
