ORDER GRANTING MOTION FOR DEFAULT JUDGMENT


Plaintiff administrator of the Western Conference of Teamsters Pension Trust Fund filed this ERISA action to collect unpaid contributions and liquidated damages, interest and attorneys fees from defendant. Defendant has not answered the complaint and has not otherwise communicated with the Court. The Clerk entered defendant's default on May 21, 2003.

Now pending before the Court is plaintiff's motion for a default judgment. Since the filing of the complaint defendant has paid the unpaid contributions owed for December 2002 through March 2004, the payments were untimely. Accordingly, plaintiff seeks liquidated damages and interest in the total amount of $2099.11, plus $900.00 in attorneys fees and $355.00 in costs. As the affidavits submitted in support of plaintiff's motion establish that plaintiff is entitled to these amounts, plaintiff's motion for a default judgment is GRANTED. The hearing scheduled for June 18, 2004 at 10:00 a.m. is vacated.

IT IS SO ORDERED.
