REPORT AND RECOMMENDATION RE REVIEW UNDER 28 U.S.C. § 1915(e)(2)(B)

On May 10, 2022, the undersigned issued an Order to Show Cause why this case should not be dismissed pursuant to 28 U.S.C. § 1915(e)(2)(B) for failure to state any viable claim. Dkt. 8. Plaintiff's response was due June 13, 2022. Plaintiff has declined magistrate jurisdiction under 28 U.S.C. § 636(c). Dkt. 2. Because Plaintiff did not respond to the Order to Show Cause and the deadline has now passed, the undersigned recommends that this case be dismissed for the reasons set forth in the Order to Show Cause. This case shall be reassigned to a United States district judge for all further proceedings, including action on the recommendation of this report. Specifically, the case will be reassigned either to the Honorable Vince Chhabria if he determines that this case is related to a previous case Plaintiff filed asserting similar claims, or to a randomly selected district judge if Judge Chhabria determines that the cases are not related. Plaintiff may file an objection to this recommendation no later than fourteen days from the date on which he receives a copy of this Report and Recommendation. The Case Management Conference set for August 5, 2022 is vacated.
