Nordenbrook v. State of New York

Appellate Division of the Supreme Court of New York, Third Department
Nov 16, 1949
276 App. Div. 796 (N.Y. App. Div. 1949)

Opinion

November 16, 1949.

Appeal from Court of Claims.

Present — Heffernan, J.P., Brewster, Deyo, Santry and Bergan, JJ.

The wife fell while roller skating in the Lake Kanawaukee Roller Skating Rink, operated by the State of New York. She rented skates which were adjusted and fastened on by an attendant at the rink. The end of an excessively long strap was looped under the buckle on her ankle. The court found that this strap pulled out of the loop, caught under the wheels of the skate, and caused her to fall. The evidence supports the finding that the attendant was negligent in furnishing skates with this long strap and in adjusting the same, and that the accident resulted from such negligence. Judgments unanimously affirmed, with one bill of costs and disbursements.
