Orders denying defendants' motions to dismiss the complaint for insufficiency affirmed, with ten dollars costs and disbursements. The two causes of action may properly be construed as common-law actions for deceit. ( Brackett v. Griswold, 112 N.Y. 454.) Lazansky, P.J., Hagarty, Carswell, Scudder and Tompkins, JJ., concur.
