As directed to do so, appellant, a vexatious litigant subject to a prefiling order, has obtained an order from the local administrative judge allowing him to pursue this appeal. See Tex. Civ. Prac. & Rem. Code Ann. §11.102(d). Accordingly, we deem the appeal properly filed.
A copy of appellant's request to the local administrative judge (LAJ) for permission to pursue this appeal was filed in this Court. Appellee filed a response, construing the request as an explanation for why permission was not required and asking we dismiss the appeal.
Having suspended the deadline for filing the reporter's record pending appellant obtaining permission to pursue the appeal, we ORDER Tina Thompson, Official Court Reporter for the 134th Judicial District Court, to file the reporter's record no later than May 28, 2024. The record shall include a transcription of the hearing held on February 3, 2021, and to the extent appellant's January 4, 2021 first amended motion for final summary judgment and appellee's December 9, 2020 motion to dismiss were not heard at the February 3, 2021 hearing, a transcription of the hearing(s) on those motions. The copy of the reporter's record appellant attempted to file March 22, 2024 is STRICKEN.
We DIRECT the Clerk of the Court to send a copy of this order to Ms. Thompson and the parties.
