Appellant is a vexatious litigant subject to a prefiling order. See Tex. Civ. Prac. & Rem. Code Ann. §§ 11.101, 11.102. Because nothing before us reflected the local administrative judge had given appellant permission to file this appeal, we directed appellant to file a prefiling order allowing this appeal or a letter brief explaining why a prefiling order permitting the appeal is not required. On December 18, 2023, the deadline for appellant's response, appellant filed a letter informing the Court that he had filed a request for permission with the local administrative judge and was awaiting a ruling.

We construe appellant's letter as an extension motion, GRANT the motion, and EXTEND the deadline for filing the prefiling order to January 22, 2024. We caution appellant that failure to obtain permission to appeal will result in dismissal of the appeal without further notice. See id. § 11.1035.

We DIRECT the Clerk of the Court to send a copy of this order to the Honorable Stephanie Huff, Local Administrative Judge, and the parties.
