JUDGMENT


For the reasons set forth in the Memorandum Decision and Order dated January 17, 2001,

IT IS HEREBY ORDERED, ADJUDGED, AND DECREED, that Boise City Ordinance 6008, creating a new Title 6 Chapter 22 of the Boise City Code titled Public Indecency, as amended by the Boise City Council on August 22, 2000 is unconstitutional, void, and unenforceable and of no effect under the First Amendment to the United States Constitution. IT IS FURTHER ORDERED, that the Defendant, its agents, servants, employees or anyone else acting in concert with the Defendant or on its behalf shall be, and the same are hereby permanently enjoined from enforcing said Ordinance.
