Appellate Division of the Supreme Court of New York, Third Department
Nov 16, 1949
276 App. Div. 796 (N.Y. App. Div. 1949)

Opinion

November 16, 1949.

Appeal from Supreme Court, Ulster County.

Present — Foster, P.J., Heffernan, Brewster, Deyo and Santry, JJ.

Plaintiff sued to invalidate charitable trusts which he created by a deed of trust in 1934. The judgment appealed from pronounced the trust as valid and subsisting. Of the various attacks plaintiff makes in an effort to undo the settlement which was made by his grant in 1934, we consider none of them effectual to invalidate the charitable trusts he thereby created. Judgment unanimously affirmed, without costs.
