ORDER

Michael J. Kelly Presiding Judge

Pursuant to MCR 7.205(E)(2), in lieu of granting the application for leave to appeal, the February 5, 2024 order denying the motion for partial summary disposition is VACATED, and this matter is REMANDED to the Chief Judge of the Washtenaw Circuit Court for assignment of the case to a new judge. The new judge will then reconsider the merits of the motion for partial summary disposition.

This order has immediate effect. MCR 7.215(F)(2). The Court does not retain jurisdiction.

Patel, J., would deny the application for leave to appeal.
