MEMORANDUM OPINION


Dung Hoang Nguyen appeals his conviction for aggravated assault. During a trial court hearing, held to determine why appellant had not filed his brief, appellant testified that retained counsel filed the appeal without authorization and he does not wish to proceed with the appeal. The Court ordered this appeal submitted without briefs. See Tex. R. App. P. 38.8(b)(4). Without briefs, no issues are before us. Finding no fundamental error, we affirm the trial court's judgment.
