DECISION & ORDER ON MOTION

Motion by respondent to dismiss an appeal from an order of the Civil Court of the City of New York, Queens County, entered June 15, 2021. Cross-motion by appellant for leave to amend the record on appeal to comply with CPLR 5526.

Upon the papers filed in support of the motion and cross-motion and the papers having been filed in opposition thereto, it is

ORDERED that the motion to dismiss is denied with leave to renew in the event appellant fails to file an amended record on appeal on or before January 28, 2022 as set forth below; and it is further, ORDERED that the cross motion is granted and appellant shall file an amended record on appeal by filing an original and four copies of the amended record, and by filing a digital copy with the court.
