N.F., Plaintiff and Respondent, v. A.B., Defendant and Appellant. B223933 California Court of Appeal, Second District, First Division June 14, 2011

NOT TO BE PUBLISHED

L.A Super. Ct. No. LF 002061., Michael J. Convey, Temporary Judge, pursuant to Cal.Const., art. VI, § 21.

ORDER MODIFYING OPINION AND DENYING REHEARING

THE COURT:

IT IS ORDERED that the opinion filed herein on May 20, 2011, be modified in the following particulars:

1. On page 4, last sentence of the second paragraph, the words “at page 18, lines 22 to 24, ” are to be inserted between the words “judgment” and “provides” so that the sentence now reads:

Contrary to A.B.’s assertion, the judgment at page 18, lines 22 to 24, provides that M.B.’s weekend visits with A.B. begin on Friday afternoon and end on Monday morning (subject to certain exceptions), thus allowing M.B. and K.B. to spend Sunday night together.

2. On page 5, first full paragraph, delete the last sentence before the citation in its entirety beginning with “A.B.” and ending with “at all” and replace it with the following:

A.B. has therefore failed to provide us with a record demonstrating that the trial court abused its discretion by sanctioning him.

This modification does not have an effect on the judgment.

The petition for rehearing is denied.

ROTHSCHILD, Acting P. J., CHANEY, J., JOHNSON, J.
