PAUL WAYNE NEWTON, Petitioner v. COMMISSIONER OF INTERNAL REVENUE, Respondent

ORDER

Eunkyong Choi, Special Trial Judge

This case was calendared for trial at the Court's Winston-Salem, North Carolina trial session on October 11,2022. On July 12, 2022, the parties filed a joint Motion to Remand in which it asks the Court to remand this Collection due Process case to respondent's Office of Appeals for further consideration. On July 19, 2022, the Court served an order granting the Motion, striking the case from the calendar and giving the parties until October 17, 2022, to file either a signed decision document or file a status report apprising the Court of the then-present status of the case. On October 17, 2022, respondent filed a Status Report indicating that as of the date of this report, Appeals has not issued a supplemental Notice of Determination. Respondent's counsel is coordinating with Appeals and will timely file a Status Report if and when a supplemental notice of determination is issued.

Upon due consideration it is hereby

ORDERED that on or before November 17, 2022, the parties shall submit to the Court either a stipulated decision or file a joint report (or separate reports, if preferred) regarding the then-present status of this case. 1
