ORDER
The appellate record was due January 26, 2018. On February 21, 2018, court reporter Patricia Holt notified the Court that appellant had not filed a pauper's oath and was, in fact, represented by retained counsel. Ms. Holt stated she had not been paid for the record nor had appellant made arrangements to pay her for the reporter's record. We also note that, to date, the clerk's record has not been filed.
We ORDER retained counsel Scottie Allen to provide this Court, within TEN DAYS of the date of this order, with written verification that he has paid or made arrangements to pay for the clerk's record and the reporter's record. See TEX. R. APP. P. 37.3. Counsel is reminded that if a non-indigent appellant fails to pay or make arrangements to pay for the record, this Court may (1) dismiss an appeal for want of prosecution for want of a clerk's record, and (2) order the appeal submitted without the reporter's record. TEX. R. APP. P. 37.3(b), (c); Sutherland v. State, 132 S.W.3d 510, 511 (Tex. App.—Houston [1st Dist.] 2004, no pet.).
