It is Ordered that the motion and cross motion are granted to the extent of dismissing the appeal unless the appeal is perfected by the February 2021 Term, the filing deadline for which is December 8, 2020. In the event defendant-appellant fails to so perfect the appeal, claimant may move on five days notice for an order dismissing the appeal.
