District Court of Appeal of Florida, First District
Nov 23, 1983
440 So. 2d 693 (Fla. Dist. Ct. App. 1983)

Opinion

No. AS-150.

November 23, 1983.

Appeal from Circuit Court, Duval County; John S. Cox, Judge.

John F. Callender of Turner, Ford Callender, Jacksonville, for appellant.

Ellis E. Neder, Jacksonville, for appellees.

New South Investments, Inc. appeals an order dismissing, with prejudice, its second amended complaint for a real estate broker's commission. We reverse.

The second amended complaint for a real estate broker's commission sufficiently alleges a cause of action as required by Rule 1.110(b), Fla.R.Civ.P. Accordingly, the order of dismissal is reversed and the cause is remanded for proceedings consistent with this opinion.

MILLS, THOMPSON and WIGGINTON, JJ., concur.
