The statute confers no right to notice upon the utility, but instead imposes a duty upon receipt of such notice. See generally, New England Tel. Tel.Co. v. Dover-Sherborn Regional School Dist., 8 Mass. App. Ct. 891 (1979). The only right involved herein was that of the plaintiff who, having obtained the necessary governmental permits and approvals, was engaged in a permissible use of a public way.
