In this negligence action to recover damages for personal injuries, defendant Jay Shlansky appeals (by permission) from an order of the Appellate Term of the Supreme Court, 9th and 10th Judicial Districts, dated April 8, 1970, which affirmed an order of the County Court, Westchester County, entered November 12, 1968, denying said defendant's motion (1) to set aside a jury verdict in plaintiff's favor against said defendant upon the issues of liability and (2) for a new trial. Order affirmed, without costs, upon the opinion by County Judge JOHN C. MARBACH [ 58 Misc.2d 128] at the County Court. Martuscello, Acting P.J., Latham, Christ, Brennan and Benjamin, JJ., concur. [ 63 Misc.2d 587.]
