IT IS HEREBY STIPULATED AND AGREED, by and between Defendant, Eric Cline (“Cline”) and Plaintiff, Kimberly Ann Neske, individually and as heir and Special Administrator for The Estate of James Neske (“Plaintiff”), by and through their respective counsel, that Plaintiff's claims against Cline are hereby dismissed with prejudice, with each party to bear their own attorney's fees and costs as to the claims against Cline only.
