Upon an appeal by the defendant from an order denying its motion for summary judgment dismissing the complaint on the merits, the order is affirmed, with ten dollars costs and disbursements. No opinion. Lazansky, P.J., Young, Hagarty, Johnston and Taylor, JJ., concur.
