This case is on the calendar of the Court's April 24, 2023 trial session for New York City, New York. Respondent filed a Status Report on March 29, 2023. In the report, respondent advised having received a signed decision document from petitioner that had been prepared by the Independent Office of Appeals. However, respondent's counsel noticed the decision document contained an error.

Upon due consideration, it is

ORDERED that this case is stricken from the above-referenced trial session, and the parties are excused from appearing at the calendar call on April 24, 2023. It is further

ORDERED that, on or before June 2, 2023, the parties shall file a proposed stipulated decision. It is further

ORDERED that jurisdiction of this case is retained by the undersigned.
