Gen. No. 44,568. (Abstract of Decision.)
Opinion filed December 13, 1948 Released for publication December 27, 1948
AUTOMOBILES AND MOTOR VEHICLES, § 120.1 — evidence supporting verdict for defendants in action for death of 10-year-old bicyclist. In action for death of ten-year-old boy whose bicycle collided with right front fender of defendants' east bound ice truck after boy had emerged from alley on north side of street, wherein plaintiff claimed negligence in failing to warn by sounding horn, in operating truck to left of center line of street, and that truck driver was under influence of intoxicating liquor, evidence supported verdict for defendants; hence allowance of plaintiff's motion for new trial was an abuse of discretion.
