ANTHONY WAYNE NEAL, Appellant v. THE STATE OF TEXAS, Appellee

From the 77th District Court Freestone County, Texas
Trial Court No. 14-138-CR

ORDER

Anthony Wayne Neal attempted to appeal the trial court's judgment of conviction signed on June 9, 2016. Because the trial court's certificate of right of appeal that Neal signed indicated that the underlying criminal case was a plea bargain case and Neal has no right to appeal, and because it also indicated Neal waived his right to appeal, we dismissed his appeal. See Neal v. State, No. 10-16-00227-CR, 2016 Tex. App. LEXIS 7431 (Tex. App.—Waco July 20, 2016 no pet. h.) (not designated for publication).

In a letter dated July 13, 2016, Neal requested the appointment of counsel for his appeal. We received his request on July 20, 2016, the date we dismissed his appeal. Neal's letter and our opinion apparently crossed in the mail.

We believe our opinion issued on July 20, 2016, sufficiently explains why this Court will not be appointing counsel for Neal to pursue his appeal. Accordingly, Neal's request for the appointment of counsel is denied.

PER CURIAM Before Chief Justice Gray, Justice Davis, and Justice Scoggins
Motion denied
Order issued and filed August 3, 2016
