The record reflects that appellant, Albert Oum Ndjock is represented on appeal by appointed counsel, David M. Ryan. On December 20, 2023, appellant filed a pro se letter, asking this Court to appoint different counsel.
We treat appellant's letter as a motion to appoint different counsel.
A criminal defendant is not entitled to hybrid representation, meaning that an appellant who is represented by counsel is not entitled to file pro se motions and briefs in the appellate court. See Sheehan v. State, 201 S.W.3d 820, 823 n.2 (Tex. App.-Waco 2006, no pet.) (citing Ex parte Taylor, 36 S.W.3d 883, 887 (Tex. Crim. App. 2001); In re Adams, No. 01-12-00021-CR, 2012 WL 589035, at *1 (Tex. App.-Houston [1st Dist.] Feb. 23, 2012, no pet.).
Accordingly, because appellant is represented by appointed counsel, the pro se motion to appoint different counsel is denied.
