Before the Court is appellant's July 6, 2022 motion for an extension of time to file his brief.

The reporter's record was filed on May 6, 2022. Exhibit 50, a DVD with proprietary software, was not filed. In a letter dated May 3, 2022, court reporter Kelly Simmons stated she had contacted "the DA to see if he can send it in a format that is the correct size to go through the Tames portal." She stated that alternatively she could file "the actual CD, if the Court would prefer that." In a letter dated May 23, 2022, we informed Ms. Simmons she could make an "exact copy of the exhibit and file the physical copy with the Court." To date, exhibit 50 has not been filed with the Court.

We ORDER court reporter Kelly Simmons to file, within TEN DAYS OF THE DATE OF THIS ORDER, a supplemental reporter's record containing Exhibit 50 or an exact copy of the same.

We GRANT appellant's motion and ORDER appellant's brief due by August 22, 2022.

We DIRECT the Clerk to send a copy of this order to the Honorable Brandon Birmingham, Presiding Judge, 292nd Judicial District Court; to Kelly Simmons, official court reporter, 292nd Judicial District Court; and to counsel for all parties.
