SCHEDULING ORDER AND REFERRAL TO MAGISTRATE JUDGE (Track: Standard)
This case was transferred to this Court by the Ninth Circuit Court of Appeals. The following schedule was agreed upon, during a telephone status conference held between counsel and the Court on January 23, 2002 , and is now adopted by the Court.
NOW THEREFORE IT IS HEREBY ORDERED, that the following recitation of deadlines and procedures shall govern this litigation:
1. Plaintiffs shall file a complaint on February 28, 2002.
2. Defendants shall file an answer to complaint on April 30, 2002.
3. Defendants shall file its motion to dismiss on jurisdictional grounds on May 30, 2002.
4. Plaintiffs shall file their response to the motion to dismiss on June 20, 2002.
5. Defendants may file any reply to Plaintiffs' response on July 1, 2002.
6. Oral argument on the motion to dismiss shall he held on July 22, 2002 at 9:00 a.m. at the Federal Courthouse in Boise, Idaho.
7. If the motion to dismiss is denied, Defendants will file a certified Administrative Record within thirty (30) days of the Court's order.
8. Within thirty (30) days of receipt of the Administrative Record, Plaintiffs will either file a motion to supplement the record via limited discovery, OR provide notice to the Court that the Administrative Record is adequate.
9. If Plaintiffs file a motion to supplement the record, Defendants may file their response to the motion within twenty-one (21) days. Plaintiffs may file a reply to Defendants' response within ten (10) days.
10. Within two (2) weeks after plaintiff's notify the Court that the record is adequate OR the Court issues its decision on the motion to supplement the record, Plaintiffs shall contact the Court's staff and arrange a telephonic status conference to schedule briefing and a hearing on the merits.
11. Referral to Magistrate Judge: This case is referred to United States Magistrate Judge Mikel H. Williams for resolution of all discovery disputes and all non-dispositive motions.
