Present — Sears, P.J., Taylor, Edgcomb, Thompson and Crosby, JJ.


Judgment and order reversed on the law and facts and a new trial granted, with costs to appellant to abide the event, on the grounds: First, that the verdict was not sustained by the evidence, whatever view may be taken of it; and second, that the evidence shows that the plaintiff was acting as a real estate broker and failed to prove that he was licensed as such. All concur.
