Appeal from an order of Supreme Court, Steuben County (Furfure, J.), entered December 11, 2001, which granted defendants' motion for partial summary judgment dismissing the third cause of action for breach of contract and injunctive relief in action No. 1 and the complaint in action No. 2 and denied plaintiff's cross motion for partial summary judgment with respect to both actions.
