No. 05-04-00601-CV (Tex. App. Aug. 18, 2004)

Opinion

No. 05-04-00601-CV

Opinion issued August 18, 2004.

On Appeal from the 160th Judicial District Court Dallas County, Texas, Trial Court Cause No. 03-13346-H.

Dismissed.

Before Justices MORRIS, WHITTINGTON, and MAZZANT.

MEMORANDUM OPINION

In a letter dated May 25, 2004, the Court informed the parties the record did not clearly indicate that the Court had jurisdiction over this appeal. Specifically, the Court noted there did not appear to be an appealable order signed by the trial judge. In addition, we noted the notice of appeal was defective. We directed appellant to file, within ten days of the date of the letter, a letter brief explaining how the Court had jurisdiction over the appeal as well as an amended notice of appeal that complied with the rules of appellate procedure.

We cautioned appellant that the failure to comply with either of the Court's instructions would result in the dismissal of the appeal. To date, appellant has not responded.

Accordingly, we DISMISS this appeal for want of prosecution.
