National Concert Artists v. Crowell-Collier Pub

Appellate Division of the Supreme Court of New York, First Department
Dec 16, 1952
281 App. Div. 673 (N.Y. App. Div. 1952)

Opinion

December 16, 1952.

Present — Dore, J.P., Cohn, Van Voorhis and Breitel, JJ.

Order unanimously reversed, with $20 costs and disbursements to the appellants, and the motion denied. The items, although numerous and seemingly broad in scope, are actually covered by the pleadings. They are material and necessary in the defense of the lawsuit. The date for the examination to proceed shall be fixed in the order. Settle order on notice.
