ORDER MEMORIALIZING APRIL 7, 2004 RULINGS


This matter comes before the Court on the Motion to Amend Complaint (Doc. 11) and the Renewed Motion for Temporary Restraining Order (Doc. 13) filed by plaintiff Wyandotte Nation. A hearing was held on April 7, 2004, at which time the Court made oral findings of fact and conclusions of law on the motions. For the reasons stated on the record,

IT IS THEREFORE ORDERED BY THE COURT that plaintiff's motion to amend complaint (Doc. 11) is GRANTED;

IT IS FURTHER ORDERED BY THE COURT that plaintiff's renewed motion for temporary restraining order (Doc. 13) is DENIED;

IT IS FURTHER ORDERED that the parties shall have 14 days from the date of this order to respond to the motion to dismiss (Doc. 28) filed by the defendants, National Indian Gaming Commission and the United States on April 7, 2004. The defendants shall have seven (7) days thereafter to file a reply. IT IS FURTHER ORDERED that an evidentiary hearing on defendants' motion to dismiss as well as plaintiff's motion for preliminary injunction shall be held beginning at 9:00 a.m. on May 4. 2004.

IT IS SO ORDERED.
