DARIUSZ J. NASIEK & SARA NASIEK, Petitioners v. COMMISSIONER OF INTERNAL REVENUE, Respondent

ORDER

Christian N. Weiler Judge.

On February 14, 2024, the parties filed a status report stating their preference on how to proceed with a trial and the expected length of trial in this case. The parties agree that it would conserve the resources of the Court and the parties to bifurcate trial into two tranches with trial of the first tranche requiring two-days to be conducted remotely via Zoomgov in early to mid-July of 2024. Based on the parties' joint status report, this case was calendared for trial at remote special session of the Court beginning on Tuesday, July 16, 2024, where Washington, D.C. was listed as the place of trial for this remote special session.

However, based on petitioners' prior counsels' withdrawal, petitioners filed a Motion for Continuance of Trial, which was granted by the Court by Order served on July 15, 2024. The Court also ordered the parties to file a joint status report by September 25, 2024. Counsel for petitioners, Reuben G. Muller and Jeffrey Schechter, entered their appearance on September 4, 2024. On September 20, 2024, the parties filed a status report, wherein the parties summarized their September 16, 2024, conference call and how a follow-up call is scheduled for October 29, 2024.

The Court is inclined to reset this case for an in-person special trial session of the Court, to be held either in Washington D.C., Philadelphia, or New York, NY on a mutually agreeable date. The undersigned has availability during the weeks of January 21, 2025, February 3, 2025, May 5, 2025, and May 12, 2025.

Considering the foregoing, it is

ORDERED that on or before November 1, 2024, the parties are to file a joint status report (or separate reports if preferred) outlining the current status of the case, including readiness for trial, whether the parties still seek a bifurcated trial, and proposed trial dates.
