ORDER


For the reasons set out on the record during the October 26, 2004 hearing, IT IS HEREBY ORDERED THAT:

1) DEFENDANT DONETTA DAVIDSON's motion to dismiss is GRANTED;
2) INTERVENORS MARK MORLAND and PARRY BURNAP's motion to dismiss is GRANTED;

3) This action is DISMISSED;

4) ALL PARTIES SHALL BEAR their respective COSTS;

5) All other outstanding, pending motions are DENIED AS MOOT; and
6) The Clerk of the Court SHALL ENTER JUDGMENT accordingly.
