STIPULATION AND FINAL JUDGMENT OF DISMISSAL WITH PREJUDICE

IT IS HEREBY STIPULATED, by and between undersigned counsel, that the parties having amicably settled this matter, this cause may be dismissed with prejudice to the Plaintiffs, PRASAD NANNAPANENI and SVM, INC. as to the original Complaint filed in this action and also dismissed with prejudice as to Third Party Plaintiffs, LAWRENCE VICTOR ASHE, individually, and BOIES, SCHILLER FLEXNER LLP, as to the Third Party Complaint filed herein, the parties to bear their own fees and costs.

FINAL JUDGMENT OF DISMISSAL

IN CONSIDERATION of the foregoing Stipulation, it is

ADJUDGED that the above cause be and the same is hereby dismissed with prejudice to the Plaintiffs, PRASAD NANNAPANENI and SVM, INC . as to the original Complaint filed in this action and also dismissed with prejudice to Third Party Plaintiffs, LAWRENCE VICTOR ASHE, individually, and BOIES, SCHILLER FLEXNER LLP, as to the Third Party Complaint filed herein, each party to bear their own fees and costs.
