Appeals having been taken to this Court from an order of the Supreme Court, New York County, entered on or about January 12, 2021, and the appeal taken by third-party defendant-appellant Koenig Iron Works, Inc. having been perfected, And an order of this Court having been entered on November 30, 2021 (M-2021-3602) deeming the unperfected appeal taken by defendant/third-party plaintiff-respondent Bernsohn & Fetner LLC as withdrawn, And plaintiff-respondent having moved to strike the December 8, 2021 brief of defendant/third-party plaintiff-respondent Bernsohn & Fetner, LLC and defendant-respondent Sugar Shack LLC or, in the alternative, grant plaintiff-respondent thirty (30) days file an answering brief to defendants-respondents' brief,

Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon, It is ordered that the motion is granted to the extent of granting plaintiff-respondent thirty (30) days in which to file an answering brief.
