DECISION AND JUDGMENT


{¶ 1} This matter is before the court on the motion of "plaintiff," Martin Todd Nagel, "To Include Affidavit and Grand Jury Proceedings." Specifically, Nagel seeks to incorporate into this court's record of his original action filed on March 1, 2011, an affidavit dated April 6, 2011, which is attached to his motion, and "certified copies of the summons of this Plaintiff before the grand jury and of the proceedings of that grand jury with his presence before them in October and/or November 2008."

{¶ 2} On March 14, 2011, this court dismissed Nagel's original action against Judge Roth for lack of jurisdiction. Nagel states that the purpose of the current motion is "to correct any insufficiency in the appeal of this case into the Ohio Supreme Court."

{¶ 3} Inasmuch as this court no longer has jurisdiction over the case and, further, because the documents that Nagel seeks to have made part of the record were never previously before this court, his motion is hereby denied.
