Nachbar v. Nachbar

Appellate Division of the Supreme Court of New York, First Department
Nov 14, 1949
276 App. Div. 756 (N.Y. App. Div. 1949)

Opinion

November 14, 1949.

Present — Peck, P.J., Glennon, Callahan, Van Voorhis and Shientag, JJ.

Order unanimously modified. The provision for the payment of $100 per week alimony is eliminated so long as the parties continue to occupy the premises wherein they now reside and defendant pays the rent, gas and electric bill and contributes $40 per week for household expenses, without prejudice to an application by plaintiff for alimony if defendant fails to continue such payments. The allowance for counsel fee is reduced to $500. As so modified the order is affirmed. No opinion. Settle order on notice.
