DECISION & ORDER ON MOTION

Appeal by Francisco P. from an order of the Family Court, Kings County, dated December 20, 2012. By order to show cause dated February 19, 2013, the parties or their attorneys were directed to show cause before this Court why an order should or should not be made and entered dismissing the appeal on the ground that the order was entered upon the default of Francisco P.

Now, upon the order to show cause and the papers filed in response thereto, it is

ORDERED that the motion to dismiss the appeal is granted and the appeal is dismissed, without costs or disbursements (see CPLR 5511).
