This case was to be tried during the Court's February 6, 2023 trial session for Dallas, Texas. Respondent filed a Status Report on January 13, 2023, and advised that a basis for settlement had been reached. Respondent requested additional time to file the proposed stipulated decision with the Court. Pursuant to respondent's Status Report of January 13, the Court struck this case from the February 6, Dallas trial session, retained jurisdiction, and directed the parties to file a proposed stipulated decision by April 7.
On April 7, respondent filed a Status Report. The report stated, among other things, that respondent wishes to concede this case in full and that a proposed stipulated decision for zero-deficiency was sent to Mr. Myatt for consideration. Subsequently, Mr. Myatt sent the document (attached as Exhibit A to respondent's Status Report) to respondent's counsel. The document suggests that Mr. Myatt does not agree with the zero-deficiency decision proposed by respondent.
In an Order dated April 10, the Court directed Mr. Myatt to inform the Court, on or before May 8, why the zero-deficiency decision as set forth in respondent's April 7, 2023 Status Report, should not be entered. As of this date, the Court has not received a response from Mr. Myatt. We will afford Mr. Myatt a final opportunity to respond. Upon due consideration, it is
ORDERED that, on or before, June 20, 2023, petitioner Beau Christopher Myatt shall file a response to this Order to inform the Court why the zero-deficiency decision, as set forth in respondent's April 7, 2023 Status Report, should not be entered. Mr. Myatt is warned that failure to respond to this Order will likely result in the Court entering the zero-deficiency decision as set forth in respondent's April 7, 2023 Status Report.
