Petitioner filed a petition for writ of mandamus. Having considered the petition and the responses from Respondent and the First District Court of Appeal, the petition is hereby granted. The First District Court of Appeal is directed to reinstate the proceeding under Florida Rule of Appellate Procedure 9.400(c) in James Musters v. Dr. Lilia Belkova, Case No. 1D11–844. Because we are confident that the district court will act in a manner consistent with this order, we withhold issuance of the writ.
