The question presented upon this appeal is the same as that presented in Murray v. Miller, No. 1 ( 85 App. Div. 414) and for the reasons stated in the opinion in that case judgment is directed for the plaintiff as prayed for, with costs. Van Brunt, P.J., O'Brien and McLaughlin, JJ., concurred; Hatch, J., concurred in result.
