Opinion
NUMBER 13-15-00324-CV
01-12-2016
On appeal from the 343rd District Court of Bee County, Texas.
ORDER
Before Justices Garza, Perkes, and Longoria
OrderPer Curiam
Appellant Tracey W. Murphy, an inmate proceeding pro se, brought a petition for a writ of mandamus and a writ of injunction seeking to compel prison officials to return legal papers pertaining to this and other appeals. See In re Murphy, No. 13-15-00593-CV, 2015 WL 9659717 at *1 (Tex. App.—Corpus Christi Dec. 30, 2015, orig. proceeding [mand. denied]) (mem. op., per curiam). We dismissed his petition as moot after the Office of the Texas Attorney General informed us that it mailed the entire clerk's record and reporter's record in this case to appellant by express overnight mail on December 22, 2015. See id. at 2.
This case is now before the Court on appellant's third motion for extension of time and a motion "to obtain his legal papers." The Court, having fully examined and considered appellant's motions, is of the opinion that appellant's motion for extension of time should be GRANTED. Appellant is ORDERED to file his brief no later than thirty days following the date of this order. Appellant's motion "to obtain his legal papers" is DISMISSED AS MOOT because it requests the same relief as in his original proceeding.
It is so ORDERED.
PER CURIAM Delivered and filed the 12th day of January 2016.
