Summary
In Murphey v. Daniels, 2008 WL 442297 (D. Or. Feb. 13, 2008), the Honorable Michael R. Hogan adopted the Findings and Recommendation of Magistrate Judge Coffin to deny the writ on the same basis. Notably, Respondent issued the same concession in almost every one of the above cases in which the Court granted the writ, but did not cease collection of restitution payments from these petitioners prior to the issuance of the writ.

ORDER
Magistrate Judge Thomas M. Coffin filed his Findings and Recommendation on January 23, 2008. The matter is now before me.See 28 U.S.C. § 636(b)(I)(B) and Fed.R.Civ.P, 72(b). No objections have been timely filed. This relieves me of my obligation to give the factual findings de novo review. Lorin Corp. v. Goto Co., Ltd., 700 F.2d 1202, 1206 (9th Cir. 1982).See also Bsitt v. Simi Vallev Unified School Dist., 708 F.2d 452, 454 (9th Cir. 1983). Having reviewed the legal principles de novo, I find no error.
Accordingly, I ADOPT Judge Coffin's Findings and Recommendation. Petitioner's petition (#I) is denied as moot.
