ORDER


Petitioner Feliciano Munoz has filed an application to proceed in forma pauperis in this habeas case brought under 28 U.S.C. § 2241. Pursuant to 28 U.S.C. § 636(b), and an order of the court in implementation thereof, this action was referred to the United States magistrate judge for proposed findings and recommendation. On September 22, 2004, the Findings and Recommendation of the United States Magistrate Judge were filed, to which Petitioner filed no objections.

The magistrate judge determined that Petitioner's application to proceed in forma pauperis should be denied because Petitioner is able to pay the filing fee without causing undue financial hardship. Having reviewed the pleadings, file and record in this case, and the findings of the magistrate judge, the court determines that the findings are correct. The magistrate judge's findings and recommendation are accepted as those of the court. Accordingly, Petitioner's application to proceed in forma pauperis is hereby denied.

It is so ordered.
