ORDER

This case was on the Court's October 2, 2023 trial calendar for Hartford, Connecticut. The most important issue is whether a K-1 that petitioner received from a close corporation was accurate. Informal discovery proved inadequate to move the case forward. Petitioner has now moved to take a third-party deposition. Because respondent consents and the prospective witness has not yet filed an objection, no motion is necessary. See Rule 74(b).

It is therefore

ORDERED that petitioner's motion to compel deposition is denied without prejudice. It is also

ORDERED that on or before February 2, 2024, the parties file a status report on their progress toward settlement, especially an update on discovery from United American Steel of Virginia.
