This case is currently set for trial at the Court's April 3, 2023, Miami, Florida trial session. On March 8, 2023, respondent filed a Motion to Dismiss for Lack of Jurisdiction as to Robert J. Mulry, Deceased, on the ground that Mr. Mulry died prior to the filing of the petition. On March 10, 2023, respondent filed a Status Report and the parties filed a Proposed Stipulated Decision. Upon due consideration and for cause, it is hereby

ORDERED that respondent's Motion to Dismiss for Lack of Jurisdiction as to Robert J. Mulry filed March 8, 2023, is granted, and Mr. Mulry is dismissed for lack of jurisdiction. It is further

ORDERED that the caption of the case is changed to read: "Audrey C. Mulry, Petitioner v. Commissioner of Internal Revenue, Respondent".
