Peter J. Panuthos Special Trial Judge.

On September 29, 2023, respondent filed a Motion to Dismiss for Lack of Prosecution. When this case was called from the calendar for the Trial Session of the Court at San Diego, California on October 23, 2023, there was no appearance by or on behalf of the petitioner. Counsel for respondent appeared and made an oral Motion for General Continuance with the Court.

Upon due consideration and for cause more fully appearing in the transcript of the proceeding, it is

ORDERED that respondent's Motion to Dismiss for Lack of Prosecution, filed September 29, 2023, is denied as moot. It is further

ORDERED that respondent's oral Motion for General Continuance is granted and this case is restored to the general docket for trial or other disposition in due course.
