After Appellant filed his opening brief, the State's brief was due on October 7, 2024. The State did not file its brief or a motion for extension of time.

On October 16, 2024, this court warned the State that if it did not file an appellee's brief, the appeal would be submitted without one.

To date, the State has not filed its brief or a motion for extension of time.

We now set Appellant Mujica's appeal for submission without an appellee's brief and treat the State's failure to file a brief as a confession of error. See Siverand v. State, 89 S.W.3d 216, 220 (Tex. App.-Corpus Christi-Edinburg 2002, no pet.). Accordingly, we will make an independent examination of the merits of the appeal, limited to the arguments advanced in the trial court.
