Appellate Division of the Supreme Court of New York, Second Department
Mar 1, 1930
228 App. Div. 856 (N.Y. App. Div. 1930)

Opinion

March, 1930.

Judgment in favor of respondents reversed upon the law and the facts, with costs, and complaints dismissed, with costs. The facts proved upon the trial were insufficient to constitute a cause of action, and justify a dismissal of the complaints. ( Strasbourger v. Leerburger, 233 N.Y. 55.) Lazansky, P.J., Rich, Kapper, Hagarty and Scudder, JJ., concur.
